The Fundamental Right to Solidarity Under the Perspective of the Constitutionalization of Private Law

Abstract

Current analysis deals with basic rights as from the constitutionalization of private law. The history of the phenomenon is investigated and the evolution of fundamental rights as rights of first, second and third dimensions is analyzed. The efficiency or not of fundamental rights in private juridical relationships is discussed as from the three main theories that guide the contents, or rather, the inefficacy of fundamental rights in private relationships; the mediate efficacy of fundamental rights; and the immediate efficacy of these precepts to private relationships. The essay will concentrate on third dimension rights, especially the right to solidarity.
