Abstract

Current research deals with the State and its function as the keeper of social peace. The idea of the separation of authority must not be tied radically to the concepts defined by contractualist doctrine since that historical period is highly different from current world view in which society is developing. The society and the individual of contemporary society are distinct from the society and the individual of that period. The essay deals with the judicialization of politics with the subsequent and necessary intervention of the Courts, within the exercise of their jurisdiction, on themes which are constitutionally defined as material proper to another authority, without such intromission is seen as unduly or beyond the powers given to it by the Constitution. The distinction between the judicialization of politics and judicial activism is required to denounce excesses from the judicialization phenomenon, especially as the product of exaggerated subjectivism at the moment of deciding. The judicialization phenomenon is a means of promotion and tutelage of fundamental and personality rights, a mean to access a just order in the defense of such rights.
