SHARED GUARD IN FRONT OF THE COVID-19 PANDEMIC AND THE PROTECTION OF THE MINOR PERSONALITY RIGHTS
Abstract
This article aims to verify the situation of parents with shared custody in times of pandemic, such as COVID-19. The problems to be pursued are: what will be the relationship between parents and children with different residences, considering the current pandemic scenario? Will what is foreseen in the agreements or sentences of shared custody be fulfilled, or in this adverse period will there be other predictions, in an emergency way, to safeguard the infant's health? Would it be the case of one of the parents interrupting, for a certain period, the coexistence with the child? Through the hypothetical-deductive method, the main results are that if the physical interaction is interrupted in order to safeguard the physical integrity of the minor and respecting his / her personality right to physical and psychological integrity, the interaction between parents and children with different residences it must occur in other ways than physical, such as through videoconferences. This would also be the case with agreements and sentences, which must adapt to the new social and global situation of the pandemic, being the temporary case of interrupting physical visits, privileging virtual contact until the vaccine is distributed, safeguarding the principle of the minor's best interest, as well as his or her personality rights, such as physical and mental integrity.
