Homofobia: The Discrimination of Sexual Orientation and the Brazilian Criminal Law

Abstract

This article aims to understand the violence motivated by discrimination on sexual orientation. Demonstrates how this practice violates fundamental rights contained in the Federal Constitution (the principle of equality, human dignity, non-degrading or inhuman treatment) and need to be configured as a crime within the Brazilian criminal law. It verifies, too, the correlation between homophobic acts and others already taken as criminals within the Brazilian Penal Code. The study covers the history of homosexuality in major civilizations and major historical moments until the current problems of discrimination by sexual orientation; studying the feasibility of examining the Draft Law 5003/2001, authored by Mrs Iara Bernardi (PT/SP), which establishes penalties for discriminatory practices on grounds of sexual orientation.
