Reduction of Criminal Age: Punishment or Measure Presumed Bankrupted?

Abstract

This article aims to discuss the reduction of criminal majority in their social, historical and legal aspects. In the social aspects the discussion is about what represents the crime in the excluded point of view. In historical aspects it is shown that juvenile crime and violence are directly related to the historic process of workers exploitation. Finally, the legal aspects do not resolve the violence and juvenile crime, simply postponing a reality that only will be solved social and historically. The study is justified by the increase of violence and juvenile crime in Brazil, driven by economic exploitation and political neglect. For both, it was contextualized this debate from the Brazilian social reality, showing the surrounding circumstances that involve the sentence completion and the foreseeable consequences that will result in the imprisonment of juveniles with adults and young people.
