City government responsibility in face to clandestine land developments and the public ministry legitimacy

Abstract

The objective of this paper is to demonstrate the city government responsibility for the negligence in supervising land developments, since they have the power/duty to act to compel developers to adjust to the law, and the possibility of adopting all measures deemed necessary. As it is a case of negligence, not only on the developers part, but also of the city government, the last should be compelled to carry out all the missing work, regularizing the enterprise in order to respect the collective interest. Besides that, it aims at demonstrating the Public ministry legitimacy in the Civil Public Action in the defense of diffuse interests, collective and heterogeneous individuals, acting constitutionally and infra-constitutionally within their attributions.
