VIRTUAL JUDICIAL RELATIONSHIPS: ANALYSIS OF CRIME COMMITTED BY USING THE INTERNET

Abstract

Technological progress has increased the use of the Internet and the judicial point of view is required to deal with the several corollary situations of such relationships. The juridical relationships established within the virtual scenario should be analyzed through the hypothetical and deductive method with regard to crimes against children and adolescents. The position of the Brazilian STJ in combating cybercrimes, especially pedophilia and its nuances within the penal aspects, is investigated from already judged cases. The promulgation of specific laws to typify electronic crimes is not enough to uproot such abuses. Massive investments are required for the social and practical conscience-awareness of public policies which are efficient toward the acceptance and protection of childhood and adolescence.
