The republicanism of cass sunstein and the equalitarian liberalism of Ronald Dworkin: an analysis under the light of the function exerted by courts in the comtemporaries democracies

Abstract

This paper analyzes the approaching movement between two lines of juridical-political thoughts apparently antithetical and irreconcilable: the republican one and a kind of line of liberal thought, named the equalitarian liberalism. It starts from the analysis of the function exerted by courts in contemporary democracies, in the vision of two theoreticians: Cass Sunstein (republican) and Ronald Dworkin (equalitarian-liberal). Both approaches the role of the Judiciary Power in the contemporary democracies, but make it under distinct perspectives. Each theoretician, for different reasons, has dissonant understanding of the other one concerning the existing relation among democracy, human rights and judiciary power, which describes the difference of paradigm and referential theoretical existing between both.
