Effectiveness Provided by Early Protection Application in the Work Context

Abstract

The present study focus the scope of injunctive relief (Article 273 of the Civil Procedure Code) under the effectiveness gore and procedure speed under the civil procedure and especially the work process, while the subsidiary application of the rules that branch is specialized in the not disposable, under Article 769 of the Labor Laws Code. Throughout this study analyzes there will be a judicial review from the effectiveness perspective, without losing focus concerning the analysis of the early relief technique and its indelible characteristics. There will be also a detailed study of injunctive relief in the general case theory lucidity, aiming to present their requirements and intrinsic and extrinsic factors assumptions, especially those common to the work process. Finally, analyzed will be the application of injunctive relief to the work process, highlighting its merits, with a view to achieving greater effectiveness and procedure speed.
