Overjustification Effect and Legal Intervention in Contracts

Abstract

A hypothesis on the overjustification effect is provided, or rather, the decrease or suppression of the intrinsic motivation to concretize certain activities caused by external stimuli, such as rewards or punishments. The first part of the article will compare the hypothesis with similar ones taken from behavioral economy. Its common and relevant clue for Law is the introduction of doubts on the dissuasion impact of legal sanctions. The second part will examine in details the implication of the overjustification effect within the context of contract law.
