The Materialization of the Right to Health as an Individual Right: Public Health Consortium in the North of Paraná (CISAMUSEP) and its Applicability

Abstract

The Brazilian Federal Constitution establishes the fundamental precept that everyone has a right to health and that it is a duty of the government to provide it. The municipal governments should apply at least minimum resources for essential health services. However, Brazilian conditions are extremely cruel and frequently people who use the public health services have to wait in hospital’s halls for medical attendance. Through the consortium system regulated by Law 11.107/2005, the Public Health Consortium of the North of Paraná (CISAMUSEP) endeavors to enhance the resources pooled by the municipal syndicate with regard to health services. Although the aims of CISAMUSEP are the best, it has limited power due to the lack of public policies with regard to the syndicate’s members.
