Civil Liabilities of the Plastic Surgeon in Surgeries When Compared to the Promised Results

Abstract
The number of cosmetic plastic surgeries in contemporary society has increased enormously either because of human vanity and consumerism or because of the psychic dissatisfaction with the patient’s well-being. Scientific and technological progress and easy access to surgical techniques contribute towards the popularity of the procedure. When the patients opt for plastic surgery, they strongly believe that the result will give the expected and desired shape, according to the doctor’s promise. However, in certain cases, the result promised by the plastic surgeon fails. This fact implies in the civil liability of the plastic surgeon with regard to the promised results; in other words, the client’s particular purpose was not achieved. Current essay shows that the juridical nature of the obligation consists of producing the desired results and this does not constitute the objectivity of the surgeon’s responsibility. The surgeon has to show that damage occurred from factors which were unrelated to the service provided.
