The Constitutionality of Private Law, Fundamental Rights and the Bonding of Private Issues

Abstract

An analysis of the juridical dogma which initially consisted of an irrefutable dichotomy between Public and Private Law and its overcoming, causing the latter’s constitutionality, was undertaken. Main analysis focuses on the constitutionality of Private Law when Constitutional Law accepted institutes that formerly and specifically belonged to Private Law. This fact implied the observance of constitutional principles and precepts by individuals. The dignity of the human person is the basic issue of the Democratic State and fundamental rights are introduced within private relationships by immediately applicable laws. The above belongs to the precept comprised in Art 5 § 1 of the Brazilian Federal Constitution by which the efficiency of fundamental rights is expected to be immediately applicable within the sphere of the state and in inter-subjective relationships among individuals. Consequently, fundamental rights apply to the relationship between individuals as far as the dignity of the human person composes its substance.
