U.S. Style Privacy and its Relationship with Brazilian Law

Abstract
U.S. privacy and its relationship with Brazilian Law are provided. The theme is a concern on the treatment that personal data receive from legal doctrine and Brazilian jurisdiction. There is a certain link between the right to privacy and intimacy and the protection of personal data. This is due to the fact that relationships between people, public and private institutions or non-governmental organizations are becoming highly demanding in data storing. In fact, concern on the protection of privacy is so high currently. Current information and vigilance society change quantitatively and qualitatively the criteria of the rights of the person. The metaphor of the glass man finds its place in the legal social and democratic state. Since Brazilian law refers explicitly to privacy and intimacy under the aegis of U.S. privacy laws, which may not be understood as the right to isolation, it is important to understand which systematization should be attributed to them. Contrastingly to what has been stated, it is relevant to define the concepts of private life and intimacy under an existential rather than a property perspective. The real person, subject to new technologies and feeling the needs for a broader and more differentiated type of tutelage, should be taken into account.
