General Aspects of Logic of Reasonable as Art of Legal Interpretation

Abstract

The rationalism synthesized the Law into cold and static formulas, making difficult its dynamics and social accompanying. The logic of reasonable, resulted from a substantial vision of the clause of “due process of law”, has as objective the justice in the creation and application of the law, having in the equity the essential tool of operation. The creative activity of the judge, which belongs to the logos of reasonable, claimed by the requirement of the fair, do not discount the maintenance of the juridical security, having as starting-point, the interpretation of the juridical rules, in a reasoning lacking the mathematical rigor, typically human.
