The Intimacy’s Right of the Employee and the E-Mails Monitoring Possibility by the Employer

Abstract

This article, prepared in some degree of proficiency, have the desire to make allowances on such conflicting subject, the relationship between employer and employee, including rights and obligations of each party involved, relevant therefore, on the employee's right to privacy and the exercise of managerial power of the employer, on a single goal: to draw a capable route of indicating a less tortuous path, relying on the wisdom of those who, thoroughly, have been studying the problem. If it is clear that there is an entire system to the protective worker, nor less certain is the steering power of the employer, in order to protect its interests, which can not be seen as unlimited. There will be considered in this light the possibility of tracking e-mails as a manifestation of the employer steering power and the imposed limits on account of the employee's personality rights, even noting the treatment that the courts have dispensed to the subject. Finally, some notes on possible guidelines, considering the conflicts composition of the involving fundamental right of the employee and the employer's directive.
