The Advertising Principle in the Arbitrational Procedures

Abstract

The arbitrational procedure, in Brazil, currently is exerted under a secrecy that does not elapse from law, but from the usual practical in result of the assiduity excess, in the compliance of the prepared in the art. 13 § 6th in the Brazilian Arbitration Law. The advertising absence in the arbitrational procedures hinders the knowledge of this modality of judgment and it does not adds a thing in relation the security of thirds that can contract with the demanded parts without knowing the eventual impediment of eviction nature. Recognizing it as a jurisdictional nature of the arbitrational judgments, it is necessary to apply the same principles established for the state judgment.
