ESTRATÉGIAS DE INTEGRAÇÃO HORIZONTAL E PROTEÇÃO DE PROPRIEDADE INTELECTUAL NA ERA DA INDÚSTRIA 4.0
A STUDY IN ENGLAND
Resumo
A Propriedade Intelectual (PI) é cada vez mais reconhecida como um ativo intangível fundamental que influencia o valor das empresas, as estratégias corporativas e a sua gestão. Este artigo centra-se no impacto da implementação da Indústria 4.0 (I4.0) na gestão de IP em redes colaborativas interconectadas interorganizacionais. Essas redes interligadas permitirão que grupos de empresas, muitas vezes concorrentes e/ou clientes, partilhem dados e colaborem na concepção, desenvolvimento e fabrico de produtos e/ou serviços complexos, trocando grandes quantidades de dados técnicos proprietários. Além disso, este artigo explora como as empresas podem beneficiar das capacidades da rede interligada e, ao mesmo tempo, proteger-se de quaisquer riscos relativos à vulnerabilidade dos activos de PI à apropriação indevida, utilização não autorizada ou fuga. O foco deste estudo é a indústria transformadora do Reino Unido, onde estão a ser implementadas ferramentas contratuais formais para apoiar a gestão da PI em projetos colaborativos. Baseia-se num estudo aprofundado das práticas de gestão de PI na cadeia de fornecimento de produção do Reino Unido para avaliar criticamente o estado atual da prática, a fim de fornecer respostas aos riscos que emanam da gestão de PI neste novo e complexo ambiente colaborativo. Este artigo conclui que as ferramentas contratuais e de PI implementadas neste novo ambiente devem ser sustentadas pela estratégia de negócios e pelo modelo de negócios. Além disso, são necessárias alterações nas estruturas organizacionais para reunir funções que normalmente operam em silos em muitas empresas industriais, nomeadamente: engenharia, tecnologias de informação, departamentos comerciais e jurídicos.
