HOW CONVINCING IS THE POSITIVIST THEORY OF H.L.A. HART?

(NOT) BACKGROUND OF CRITICISMS

Abstract

This article discusses the positivist legal system as presented by Herbert Lionel Adolphus Hart, who based his work on the theory of legal positivism as first stated by Jeremy Bentham and John Austin. And more, after analyzing counterpoints, mainly in the work of Ronald Dworkin, this writing seeks to scientifically outline arguments in order to spread unfounded criticisms and misreadings of the Hartian theory, concluding by an assessment of how convincing the Hartian theory remains, despite so many debates and criticism suffered over more than four decades.
