Abstract

The Court of the Jury is the responsible institution for the judgment of the crimes against life, characterized for a democracy attitude. For the fact that Brazil is a Democratic State of Law, endowed to express thoughts and opinions, initiates here a confrontation with another present basic right in the article 5 of the Federal Constitution of 1988, which assures the free expression of the activity of communication. It is verified what if it can attribute on the conclusions of the Jury, composed by people of the society, and its consequences when influenced by the press, where there is the conviction of the defendant before of its judgment. One becomes important to display the relevance of the Brazilian Judiciary in leading a coherent judgment, since the moment of the denunciation until the final judgment, without any form of influence in the base of the popular legitimacy.
