Aspects of organized crime in relation to the rightful democratic state

Abstract

The aim of this work has been to study organized crime and how this affects the Rightful Democratic State as defined in the introduction of the article nbr.1 of the 1988’s Federal Constitution. We set out to analyze the need for a readjustment of the system so that it is able to fight the crimes that effectively impair the implementation of the social principles and rights, since these crimes threat the objectives proposed by the Rightful Democratic State, which are: to ensure the exercise of social and individual rights, freedom, security, well-being, development, equality and justice.
