The Status of the Brazilian Prison System: Limitation of Fundamental Rights in Brazilian Detention Houses

Abstract

Current analysis examines the lack of intervention of the government in Brazilian prisons. The guarantee and effectiveness of human rights in a democratic state is warranted by a list of fundamental rights and guarantees in the Constitution. Besides repression of human dignity against the precepts of the Federative Republic of Brazil, the suppression of basic human rights, such as the right to health, food, a worthy life, ise common in Brazilian prisons. Current analysis describes the lack of primary human rights within the prison system even with the introduction of laws and plans to guarantee minimum dignity to the Brazilian convict.
