The Territorial Limitation of The Res Judicata in Collective Actions

Abstract

This article's subject takes place on the collective action’s context and its development in the Brazilian law. As a matter of fact, the discussion concentration was about interests or rights which concern that the general population has provided, in the 90’s, a real legal control of public politics. Therefore, it has affected the federal government’s patrimonial interests at that time, which used the “provisory extremities” in order to restrict the effects of judge’s decisions on the collective custody conflicts. It has been modified, in this way, the composition of the article 16 of the Federal Rule 7.347/85 (Law of Public Civil Action), which produced territorial limits for judicata on legal decisions, which should be, spread without any limitations for the guardianship object. Thus, what results from that is a discussion about the legitimacy of that legal reform, regarding its constitutionality as well as the potential damages that it may cause to collective litigation. Finally, there are compared the present legal situation with the new arrangements made on the Project of Federal Rule nº 5.139/2009, which, if becomes approved by the parliament, will regulate the collective actions in Brazil.
