Sexual Harassment in the Labor Relationship

Abstract

It is well-known that the economical crisis introduced a high number of women in the labor market, promoting like this, a larger relationship between men and women. This familiarity has been promoting, mainly, the sexual harassment that it is exercising serious influences on the levels of work quality and company competitiveness, and consequently, being reflected in the workers' life conditions and in the atmosphere that they develop their activities. In the sense of deepening knowledge concerning this subject, we search for legislation, jurisprudence and doctrine, necessary elements to draw a general panorama on the sexual harassment in the relationship labor theme. This study has as objective to know and to analyze the labor relationships that are established due to the somebody embarrassment with the intention of obtaining advantages and sexual fostering, prevailing the agent of his/her position or exercised function. Highlighting, that this attitude violates the worker's intimacy right, as well as, the human dignity, constitutionally insured warranties, the employer or coworker is not able to violate them.
