Abstract

The guarantee of judicial effectiveness is a basic right contemplated in Article 5, paragraph XXXV of the Brazilian Constitution. Constitutional Amendment 45 makes explicit the essential importance of fastness in judicial processes. Fastness and effectiveness are constitutionally basic rights. So that fastness in judicial processes could be achieved, the legal system has been endowed by a mechanism which entails legal holdings of the Supreme Federal Court with binding precedence. The stare decisis becomes a technique to guarantee the basic rights mentioned in Article 5, paragraphs XXXV and LXXVIII of the Constitution with the aim at improving judicial assistance.
