The Heinousness of Slave Labor in a Democratic State Based on the Dignity of the Human Person

Abstract

The 1988 Brazilian Constitution is the product of awareness in the defense and materialization of the individual’s and society’s basic rights in different areas. The democratic state is accepted as basic and its role is defined as “the guarantee of the exercise of social and individual rights”, comprising well-being, development, equality and social justice. Following contemporary constitutionalism, the Constitution expressly included in its text the principle of the dignity of the person as the most supreme value which foreground the Republic (Art. 1, paragraph III). Since slave labor is a cruel form of treating the human being, the issue constantly requires a current and detailed discussion which contributes towards the shunning of objectification of the person.
