Penal Law and the Rights of the Person: Transgenic Organisms and the Protection of Human Life in the Law on Biosecurity

Resumen

Aspects on the penal protection of human health, as a right of the person, and its risks are analyzed with regard to the Biosecurity Law dealing with the production, commercialization and consumption of genetically modified organisms (GMO), commonly known as transgenic products. The essay analyzes the manner the principle of precaution in the safety to human health is observed within the context of economical interests underlying the commercialization and consumption of GMOs in Brazil. Results show that a lack of efficaciousness in penal protection exists within the juridical concepts of Law 11.105/2005
