The Idea of Ethical Criterion as a Counterpoint to the Crisis of Juridical Positivism

Abstract

Current research deals with the ethical criterion and its power to modify contemporary juridical positivism. It questions in what manner it may help in the application of law, taking into account a balance between the judge´s subjective decision and the pure application of the law within the context of a crisis in juridical positivism. The historical context of juridical positivism and its main defenders are studied. The modifications brought forth with juridical post-positivism are also verified. Current research proves that, foregrounded on Ethics, contemporary juridical positivism may be modified. The deduction method is adopted through the analysis of works by Brazilian and foreign authors dealing with philosophy and law.
