The Efficiency of Law Towards the Dignity of the Human Person

In Law, the orientating principle of juridical order is the dignity of the human person. The Brazilian constitution guarantees dignity as a basic factor of the Republic which, in turn, established limits to the constituting executive and legislative powers and to society’s attitudes. The dignity of the human person was effectively placed in the Brazilian constitution in the wake of the terrible atrocities by previous administrations. The dignity of the human person has currently the fundamental role to warrant the law-abiding democratic state. Since it is the main protection of fundamental rights, the dignity of the human person defends all forms of human life. So that human life could be protected in its very essence and in its physical, intellectual and psychological development, the right to human dignity should be applied since its efficacy is the Constitution’s basic of life’s dignity.Downloads
