Access to Law as a Fundamental Right and Guarantee and its Importance in the 1988 Brazilian Constitution for the Safeguarding of the Person´s Rights

Abstract

The theme of current article, retrieved from a Seminar in the postgraduate course on Juridical Sciences, should be studied deeper and discussed widely. It deals with access to the Law as a basic right and guarantee foregrounded on the 1988 Constitution of Brazil, on international agreements and on the person´s rights. The right to the Law and access to Justice within the Constitution are investigated. Comments and discussions on the concepts of the rights of the person are forwarded with special reference to the importance of accessing Justice in issues involving these rights, essential to humans and true attributes. Since the person is the focus of juridical ordering and of the State, the principle of the dignity of the human person is foregrounded and investigated.
