Personality rights inherent to marriage and homo-affective union

Abstract

We are involved in a turmoil of social, political and cultural movements, as we can see in the countless changes that occurred, with great emphasis from the second half of last century, which, in a certain in an indelible way, had direct and immediate reflexes in the juridical world. This scenery of intense changes that occurred in the last decades reveals, from a phenomenon-ideological point of view, undeniable transformation in the family structure. Personality rights are highlighted in the conception of the modern family, as well as in the recognition of unions of equals as a specie of family entity gender.
