Contributions of the Philosophy Right for Acceptance of Noise Marks in the Brazilian Law

Abstract

This study aims to examine the issue of registration of sounds as trade marks in Brazil, denied by the Brazilian government on the considerate Law No. 9279/96, through the concept of registration signals that brings, so determined. To achieve its goal, take its evolution, examines the legal regulation of the subject and demonstrates the inadequacy of exclusive literal interpretation to obtain the direction and scope of legal rules, subjecting it to inquiry about the possibility of sounds registration as brands in Brazil, the priorities for other relevant interpretative processes and concluding that proper interpretation of Brazilian law on the subject is one that allows registration in Brazil as a sign of publication, among the ones that includes the sounds.
