Disobedience of judicial order of corpus separation

Abstract

This article shows the content and the effectiveness of the urgent judicial measure that determines corpus separation of the couple, pleaded when there is the risk of offense to the physical and mental integrity of the partner. The effectiveness of the determination will only be reached with the full guarantee of the separation from the matrimonial home, and of safe distance between the parties. The sanctions, consisting of fine and imprisonment, must be used coercively as well as punitively, always anchored on the article 461 of CPC, without any detriment of the sub-rogatory measure, provided it is appropriate to the specie.
