JURIDICAL TUTELAGE OF THE BRAZILIAN GENETIC HERITAGE

Abstract

The Brazilian genetic heritage, which is directly related to national biodiversity, includes animal, vegetal, microbiological and human DNA. Genetic breakthroughs have brought new perspectives on the possibilities of their use in modern society. The juridical focus is based on Bioethics that directs the viability of research by the pharmaceutical and biotechnological industry and the manipulation of human genetic material. The control of this juridical asset is perceived within fundamental human rights approached from the historical angle and proposed as a fourth dimension. An analysis of Brazilian and Comparative Law provides the formulation of an interlocution between Bioethics, Genetics and Law, and makes possible broader information on the best juridical control to be given to the theme.
