Personality rights and the prisoner’s integrity in prisons in Santa Catarina State

Abstract

This research has as main purpose, beyond the achievement of the social function longed for, the partial requirement of evaluation in the discipline ‘Personality Rights’ from the Master´s Degree in Legal Sciences at CESUMAR (Centro Universitário de Maringá), ministered by professor Dr. Wanderlei de Paula Barreto. The primordial aim is at verifying if the prisoner´s personality rights are being respected in prisons in Santa Catarina State, especially relating to the right of using their names, the privacy protection, the physical and psychic integrity, as well as the security and conviviality of the interned one what provides life dignity. It is necessary to analyze some aspects concerning the personality rights, in relation to the treatment given by the State to the prisons, to know if those rights are being protected according to the Law of Criminal Execution, what synthesizes the biggest desideratum of this study.
