Social Function in Health Contracts Under the Point of View of Personality’s Rights

Abstract

The theory of contracts in the contemporary Law is a target of a transformation where traditional concepts give place to new conditions that especially intend to keep the good faith principles, dignity and social function, always aiming the personality’s rights. To interpret such principles related to health care plans requires a re-reading of general theory of contracts. Aiming especially the law’s Constitutionalization and the search for contractual balance, safeguarding the social function in relation not only to the beneficiary but also to the health care companies that have an important part of economic balance in society.
