Arbitration as a Dispute Settlement Mechanism Involving Legal Relations of Heritage Character

Abstract

The commercial arbitration has been consolidated as one of the preferred methods for settling disputes, especially in the contract case. Disputes over international contracts are typically resolved through arbitration, as individuals prefer a body that acts quickly, secret, and usually held by private institutions also dedicated in the area. The arbitrators are chosen by the parties and, in general, have remarkable experience in the questions under the trial. The arbitration award is required and can be enforced in the same manner as the court ruling. As Brazil finally promulgated the New York Convention of 1958 on the Recognition and Enforcement of Foreign Arbitration Awards Reports, it is part of the country, increasing in the vast chain of international trade.
