Environmental Law as an Integrating Factor of the Existential Minimum Contents to Guarantee the Other Rights of the Personality

Abstract

The contents of the existential minimum are related to the fundamental right to an ecologically balanced environment, according to Article 225 of the Brazilian Federal Constitution. An analysis of the concept of environment and its fundamentality is provided and the fundamental (social) rights that are part of the classical contents of the existential minimum nucleus are given. The authors would like to contribute towards the inclusion of fundamental law to a balanced environment within the concept of the existential minimum due to its indispensability for the dignity of the person, which is the basis and guiding principle of the Brazilian republic. All the rights of the person depend intrinsically on a healthy environment proper to human life.
