Abstract

Civil responsibility, in the violation of the human being dignity in the conjugal partnership, is a theme that has been undergoing doctrinarian and legal changes on the trail of those that have already taken place in other countries. In family relationships, the need to protect the human being dignity is highlighted, since the family must be understood as the center for the person’s preservation, the essence of the human being even before being seen as society’s the basic cell. The protection of the person’s dignity, in their conjugal relationships, is based on the isonomy between men and women, and in the partners’ reciprocal respect of personality rights. The preservation of this major value must occur not only in the course, but also in the end, of conjugal relationships, and thus, the application of the principles of civil responsibility is indispensable, which confer to the aggrieved partner the due compensation for moral and material damages incurred from the offenses to their personality rights.
