Abstract

The fundamental question to be seen on the present study is about the duty of the culprit spouse for litigious judicial separation to repair the moral damages caused to the other by his/her guilty act, in the specific case of a virtual infidelity, as well as to demonstrate the necessity of review of millenarian Law concepts and the creation of new concepts and definitions of facts, previously, not foreseen. Thus, the aim is at searching protection in the family law, as well as on personality rights and, consequently, positive solutions we can see within the social and technological evolution occurred on latest years.
