The Proposal of an Environmental Sustainability Index: A Tool for Tackling Climate Change
Abstract
International conflicts have the legal system as a strong ally for their resolution. With environmental issues is no different. However, cross-border problems involving natural resources require more than law enforcement because they involve economic, social issues, human interests and the application of specific principles. From the analysis of the cases judged by the International Court of Justice and the International Court of the Law of the Sea, we could consider that those organizations are not effective aligned with the environmental protection. These findings required a paradigm change. States have opened, under the spotlight of environmental governance, the Framework Agreements and international environmental regimes with their own dispute settlement mechanisms. The question is whether the jurisdictional or regime-based means are effective in resolving cross-border conflicts. In addition, if the elaboration of the Environmental Sustainability Index could be another instrument capable of enforce the States to voluntary comply with their international environmental obligations.References
