Transexual, Sex Reassignment the Free Personality Deployment

Abstract

Transsexuality, understood as a Gender Identity Disorder, it becomes intensely debated from the moment we get the possibility of surgical intervention for the adequation of biological sex to the psychological gender, with the diagnosis of such cases. The study asks the existence of the reassignment right from the syndrome and the legal repercussions observation arising from it. From this, transgenital surgery comes as the fulfillment of constitutional principles such as human dignity, which is based in the free unfolding of personality and the right to health, understood in a wide sense, such as physical and psychic. Moreover, the work, rooted in the hermeneutic method, investigates the right to gender reassignment and first name, which allows the emergence of a new legal personality, that is why we investigate the legal consequences.
