The inclusion of the personality rights in the 1988 Constitutional Charter confirms the development of these rights. It established a close relationship between personality rights and the human dignity principle. One can infer that they are the instruments to implement this principle situated at the legal system apex. The image in the contemporary world (characterized by technological advances) represents an excellent language form, in terms of efficiency, widely used in the mass communication media. Therefore, the image acquires indisputable economic valuation. It should be noted that the image, even before payment term, is a person attribute and, therefore, has social values. Thus, the image is inserted in the list of personality rights. The image, in the contemporary scene, deserves special attention from the law. Besides, it is essential to say that a right to own image as an autonomous right. For more effective image protection and all legal rights object of personality rights, it is not necessary to demonstrate the harmful consequences of their disrespect, what is called harm in re ipsa.Downloads
