Abstract

Current paper analyzes whether compulsory hospitalization of crack-dependent people is an episode similar to the hygienist policy in the 19th and 20th centuries. The hygienist campaigned had more interests in the bulk of society than in the cure of the people concerned. It seems that current activities may be compared to the compulsory segregation of people with Hansen´s disease in the past. The study also investigates whether such a public health policy respects the rights of the human person and whether the way adopted for compulsory hospitalization respects constitutional and legal rights, especially those of Act 10,216 of 2001 which deals with the basic rights of the diseased. The paper also analyzes tallies on the situation of crack consumption in Brazilian towns and discusses whether compulsory hospitalization is a measure restricted to big cities or an integrated policy for the treatment of the ill person.
