PUBLICATION OF PUBLIC ACTS AS A GUARANTEE OF THE DEMOCRATIC STATE: THE INFLUENCE OF NORBERTO BOBBIO ON THE DECISION OF THE BRAZILIAN SUPREME COURT

Abstract

References to the writings of Norberto Bobbio in the decisions of the ministers of the Brazilian Supreme Court triggered questions on the influence of the Italian author on their decisions. Since several themes emerged from current research, focus has been placed on the analysis of decisions on the publication of public acts. Bobbio´s influence may be evidence by his concept of democracy as ‘the government of visible authority’, controlled by the people, based on general, true, constant and non-retroactive norms. The above items denote the influence of the concepts of the Italian author on the construction and maintenance of democracy and democratic power through the Courts in a country immersed in a deep political crisis. Results deal with juridical positivism and Bobbio´s doctrine, coupled to his concept of the democratic state.
