The Applicability of the Theory of the Obligations of Means and the Obligations of Result for Consent in Assisted Human Reproduction Techniques

Abstract
The obligation of means and obligations of results theory and its applicability is analyzed within the context of contracts by specialized clinics and hospitals for assisted human reproduction by any technique. Research was first undertaken on the contract employed in the establishment of juridical negotiation between assisted human reproduction clinics and their patients, namely people who are interested in artificial fecundation technique. The contract provides not only for the provision of medical services but also more specific documents to be employed in certain circumstances, namely, consent for techniques in assisted human reproduction, authorization for in vitro or artificial insemination fertilization with oocyte/semen donated or ceded free of charge, the cryopreservation of semen, and others. When the first specific document is analyzed in detail, the establishment of contracted obligation has been detected, in one of its topics, as an obligation of means and not of result. The viability of the above definition is questioned and an analysis of the theory of the obligation of means and the obligation of results is undertaken. It is thus inserted within the information on consent for assisted human reproduction techniques and related to the theory on civil responsibilities.
