Abstract

Current paper analyzes the theory of “Disregard of Legal Entity” of a company in a Labor Suit when executing the employees´ credit. The origins and causes to disregard the legal entity of a company are investigated, coupled to an analysis of the norms which authorize the application of this theory in Brazilian law, especially in Labor Procedural Law. A greater focus is given on the manner Labor Courts and their magistrates act when discarding legal entity, the manner it is applied, and the omission of law on the specific norm in Labor Rights and Labor Procedures that authorize execution within the context of partners while observing the limits of responsibility of each member in the company. Method implies rational deduction for reaching conclusions.

Doutorado Em Direito das Relações Sociais pela Pontifícia Universidade Católica de São Paulo (2004). Também é doutor em Desenvolvimento Econômico, título obtido junto ao Instituto de Economia da UNICAMP (2011).
