CONCILIATION OF SPECIAL COURTS AS A FUSION OF HORIZONS

Abstract

The courts are currently in crisis since people, as a rule, do not trust the juridical processes since they do not expect to find justice in their conflicts. The causes are numberless, with the underscoring of delay in procedures, the traumas caused in those involved and the gap between the judiciary and the people. Several alternative forms of solving conflicts, such as conciliation, have been adopted instead of the jurisdictional manner. Current paper demonstrates how conciliation in Special Courts may establish a real fusion of horizons. The inductive method by bibliographical research is used to this end. The dialogic praxis in Conciliation Courts makes the parties place their horizons in evidence, with a sort of confrontation, by which each party may discover something about themselves. A transformation occurs in both so that an agreement and a fusion of horizons may materialize.
