Reproduction of Gender Hierarchy in the Teaching of Law: New Horizons from a Feminist Jurisprudence of Law

Abstract

Law as a masculine field is denounced; likewise, how this type of logic reproduces itself through the teaching of law which structures itself by a reasoning that erases female-related discursive practices. Employing the ideas of Critical Legal Studies by Duncan Kennedy (1984), the manner teaching law works is described, especially, when denouncing law as a socially, politically and economically engaged practice which reproduces itself by a hierarchized system of the above-mentioned categories. Further, it may be asked whether the hierarchical pyramid similarly presupposes a gender asymmetry which is taken through the configuration of teaching of law as a practice that reproduces phallocentric paradigms as an argument and a discard for the particular, experience and context. The writings of US author Carrie Menkel-Meadow (1988) are discussed. An imagination exercise is undertaken to propose possible changes in the model of hierarchical teaching, marked by the male gaze.
