INQUISITORIAL CULTURE MAINTAINED BY META-JURIDICAL AIMS FOR PENAL PROCEDURES

Abstract

Adopting a non-inquisitorial model is part and parcel to a theory of process within the democratic state. It is important to adopt theoretical models that remove from the judging entity the superiority stance and place it on an equality plane with regard to the other subjects. A revision of theory in juridical relationship, especially in its instrument stance, attributes meta-juridical aims to the process and provides the judging entity with functions which do not belong to it. It is actually transformed into a true justice-enforcer not complying with the democratic process and makes it close to the inquisitorial model.
